Resolution Run to Kick Cancer 5K

By indicating your acceptance, you understand, agree, warrant and covenant as follows for yourself or, if the participant is under 18 years, as the participant’s parent or legal guardian: I know that running is a potentially hazardous activity and can result in severe injury. I hereby attest that I am sufficiently trained to complete the event knowing the risks involved. I agree to abide by any decision of the race officials relative to my ability to safely complete the 5K event. I assume all risks associated with participation in this race including, but not limited to, serious bodily injury, falls, illness, permanent disability, paralysis, loss of life, loss of or damage to equipment/property, contact with other participants, spectators, animals or other natural or manmade objects, the effects of adverse weather, including cold, snow and/or ice, and the conditions of the road and traffic, all such risks being known and appreciated by me. Having read and accepted this waiver and assumption of risk and knowing these facts, and in consideration of your acceptance of my application and my participation in the event, I, for myself and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby waive and release Resolution Run to Kick Cancer, Inc. (“RR2KC”), the event organizers, volunteers and officials, USA Track & Field, Inc. (“USATF”), the Town of Lexington, and all event sponsors, and their respective representatives, officers, directors, partners, shareholders, members, affiliates and successors (individually and collectively, the “Released Parties”), from all liability, claims, demands, causes of action, damages, loss or expense (include court costs and reasonable attorneys’ fees) of any kind or nature (“Liability”), which may arise out of, result from, or relate in any way to my participation in the event, including claims for Liability caused in whole or in part by the negligence act or omission by any of the Released Parties. I acknowledge and agree that all fees are non-refundable, including in the case of cancellation of the in-person event due to inclement weather or COVID-19 mandates. I will follow all COVID-19 protocols to be determined and communicated before the event. I understand if the in-person race is canceled, I will have the opportunity to participate in the virtual race. I hereby grant full permission to the Released Parties to use my likeness in all media, including photographs, pictures, video recordings or any other record of this event for any legitimate purpose.
